- Q: Where do I get a copy of my deed restrictions?
A: The Urban County Government does not have that information, and cannot enforce private deed restrictions. Recorded deed restrictions can be found at the office of the Fayette County Clerk, 162 East Main Street, Lexington, KY. The staff in that office can assist you in your search.
- Q: Where can I get a copy of my subdivision plat?
A: If your house is less than 20-25 years old, you can probably find a copy of your subdivision plat at the Division of Planning office at 101 East Vine Street, Lexington.
If it is older than that, you probably will need to pay a visit to "the vault" at the office of the Fayette County Clerk, 162 East Main Street. If you need more information about
your property than appears on the plat (such as where structures and pavement have been placed on your lot, for example), you may need to hire a professional land surveyor
to survey your lot, and the improvements on your property.
- Q: Will the Urban County Government survey my property?
A: No, but Planning Services can provide a listing of local land surveyors and engineers if the listing found in the yellow pages of your local phone book is insufficient. Planning Services can not "recommend" a surveyor or an engineer to you.
- Q: Why is the mortgage company telling me I must purchase flood insurance? My house has never flooded in all the years I've lived here!
A: Planning Services is asked every day by lending institutions whether or not properties
in Lexington-Fayette County are "in the floodplain" or not. We rely upon maps supplied by the Federal Emergency
Management Agency to answer those inquiries. We also have more detailed maps that also can be of help
in such determinations. These maps identify areas listed as "100-year floodplains" generally meaning that those
areas can expect to flood at least once in 100 years. Most lending institutions have different requirements
for properties that fall within the federal government's mapped floodplain areas, which were last updated
on September 3, 1992. Planning Services can refer you to federal agencies if you, your land surveyor or
engineer wish to ask FEMA to amend their floodplain map for your property, or for your neighborhood.
- Q: Can I put a sign on my property?
A: Article 17 of the Zoning Ordinance provides the regulations for all signs in Lexington-Fayette County. Some Planning Services staff are familiar with this section of the ordinance. However, in most cases, you will need to obtain a Sign Permit from the Division of Building Inspection, located in the Phoenix Building.
